Membership of this Committee is specified by section 105(2) of the Land Transport Management Act 2003 and consists of two Regional Councillors: Crs Rachel Keedwell (Chair) and Sam Ferguson, together with seven members representing Territorial Authorities including Horowhenua District Council (one from each Territorial Authority in the region), and one member representing the Waka Kotahi (New Zealand Transport Agency).

This Committee plans and promotes the establishment of an affordable, integrated, safe, responsive and sustainable land transport system for the Manawatū-Whanganui Region.

1.       This report seeks Council approval to reclassify the Muhunoa Road West Esplanade Reserve as a recreation reserve and to grant a licence to Grenadier Limited for the purpose of establishing a golf course on a portion of the reserve. This report follows the close of the public submission period, during which no submissions were received.

This matter does not relate to a current Council priority.

Executive Summary | TE WHAKARĀPOPOTOTANGA MATUA 

2.      The public notification process for the reclassification of the reserve and granting of a licence has concluded with no submissions received. Efforts were made to engage with iwi partners, advertise in local newspapers (Horowhenua Chronicle and Manawatū Standard), and provide details on the Council website.

3.      The report recommends that Council proceed with the reclassification of the Muhunoa Road West Esplanade Reserve to a recreation reserve and grant a licence to Grenadier Limited for the proposed golf course development, subject to specific terms and conditions.

DELEGATION OR AUTHORITY TO ACT | TE MANA WHAKATAU I NGĀ KAWENGA 

4.      Council holds the authority under the Reserves Act 1977 to reclassify reserves and to grant licences over reserve land.

5.      Public notification requirements under the Reserves Act have been met, and no further consultation or hearings are necessary given the absence of submissions.

SIGNIFICANCE ASSESSMENT | He Aromatawai Matua

6.       This matter is assessed as having medium significance under the Council’s Significance and Engagement Policy. While the reserve reclassification involves public land, the absence of submissions indicates minimal public concern.

RECOMMENDATION | NGĀ TAUNAKITANGA

A.      That Report 25/1 Esplanade Reserve Reclassification and Licence to Occupy be received.

B.      That this matter or decision is recognised as not significant in terms of S76 of the Local Government Act.

C.      That Council resolves to reclassify the Muhunoa Road West Esplanade Reserve as a Local Purpose Recreation Reserve.

D.      That Council resolves to grant a licence to Grenadier Limited for the establishment of a golf course, based on the following key terms:

·     Licence Term: 99 years (33+33+33).

·     Public Access: A defined public walkway connecting Muhunoa Road West to the beach, to be developed and maintained by Grenadier Limited.

·     Environmental and Cultural Protections: Conditions to safeguard environmental and cultural values.

 

Background | HE KŌRERO TŪĀPAPA

7.       The Muhunoa Road West Esplanade Reserve was vested in the Council for esplanade purposes, primarily to provide public access and protect conservation values. The reserve spans approximately 2.5 kilometres of coastline and varies between 45-55 metres in width. Over time, accretion has added an additional 80-85 metres of land, significantly increasing the reserve’s potential for recreational use.

8.       Grenadier Limited approached the Council seeking to develop a portion of the reserve as part of an 18-hole golf course. The proposed development aligns with recreational purposes but requires the reserve’s reclassification to ensure compliance with the Reserves Act. The development would occupy approximately 35% of the reserve while preserving public access and natural conservation areas.

9.       Council has been well-briefed throughout the development process and has received direct presentations from Grenadier Limited, ensuring that Elected Members have a clear understanding of the project, its potential impacts, and the associated legal and procedural steps. These discussions have provided an opportunity for Council, ask questions, and gain assurance on key matters, including public access, environmental safeguards, and compliance with statutory requirements.

10.     At the Council meeting on the 27 November 2024 the following resolutions were passed.

G.        That, subject to the reclassification of the esplanade reserve to a recreation reserve, Council proceeds with public notification of its intention to grant a licence to Grenadier Limited, based on the following key terms:

H.        Licence Term: A maximum term of 99 years (33+33+33).

I. Public Access: Continued public access through a defined public walkway connecting Muhunoa Road West to the beach to be developed and maintained by the licensee.

J.         Environmental and Cultural Protections: Conditions to safeguard environmental and cultural values.

L.         A division was called for. The division was declared CARRIED by 9 votes to 3

P.        That Council publicly notify its intention to reclassify the reserve to a recreation reserve.

11.     The public notice was published on Friday 06 December 2024, a copy of the notice is below.

Proposal to reclassify Muhunoa West Road Esplanade Reserve and grant licence under the Reserves Act 1977.

Horowhenua District Council hereby gives public notice that:

 (a)   in accordance with section 24(2)(b) of the Reserves Act 1977, it intends to consider a proposal to change the reserve classification of a portion of the Muhunoa West Road esplanade reserve (Lot 4, DP 44581) from local purpose (esplanade) reserve to recreation reserve.  The reason for the proposal to provide a more suitable reserve classification for the proposed use of that part of the reserve for a links golf course. The remainder of the reserve will retain its status as esplanade reserve; and

(b)   if the classification of the reserve is changed to recreation reserve, then in accordance with section 54(1)(d) of the Reserves Act 1977, it intends to consider a proposal to grant a licence to allow Grenadier Limited to use a portion of the reserve for the purposes of a links golf course, for a term of 33 years (with two rights of renewal of 33 years each (a total potential term of 99 years)) at a market rental to be determined by valuation and subject to a condition that a walkway be constructed from the end of Muhunoa West Road to the beach.

Written objections or submissions regarding this proposal should be sent to Horowhenua District Council, Private Bag 4002, Levin 5540 or sent by email to enquiries@horowhenua.govt.nz no later than 5pm on 15 January 2025.

Submissions close at 5pm on 15 January 2025.

12.     Reclassifying the Muhunoa Road West Esplanade Reserve as a recreation reserve provides a more suitable legal framework for the proposed golf course activities and aligns with the Reserves Act’s provisions for recreational use. This classification supports the dual objectives of facilitating private development and maintaining public access.

13.     The absence of public submissions and engagement from iwi partners suggests broad community and stakeholder acceptance of the proposal. Direct efforts to engage iwi partners, including emails on 06 December 2024 and 07 January 2025, alongside public advertisements, ensured transparency and inclusivity in the process.

14.     The reclassification process involves passing a Council resolution, public notification of the intent to reclassify, and consideration of any submissions received during the notification period. The absence of submissions simplifies this process, allowing the reclassification to proceed without delay. Following the resolution, the reclassification will be finalised through notification in the Gazette, completing the statutory requirements under the Reserves Act.

15.     The proposed licence terms ensure that the reserve’s environmental and cultural values are protected. Grenadier Limited has committed to developing and maintaining a public walkway connecting Muhunoa Road West to the beach, addressing a long-standing community need for improved access.

16.     Historically, informal community efforts to create a public access walkway faced challenges, including legal disputes with adjacent landowners. The proposed public walkway, to be constructed and maintained by Grenadier Limited, formalises and improves public access, addressing a long-standing issue while minimising Council costs.

17.     Option A is recommended as it provides a clear legal basis for the proposed activities while balancing public access and environmental considerations.

ENGAGING WITH MĀORI | TE MAHI TAHI KI TE MĀORI

16.     Direct emails were sent to iwi partners on 06 December 2024 and 07 January 2025 informing them that we were seeking their input and inviting them to submit . No submissions were received throughout the process however officers recognise the importance of ongoing communication and engagement as we move through the reclassification and the development commences.

17.     While no feedback was received during the submission period, Ngāti Kikopiri has previously expressed written support for the development when seeking iwi / hapu input to a previous council paper on this topic.

CLIMATE CHANGE | NGĀ ĀHUARANGI HURIHURI

18.     The proposed development includes measures to enhance climate resilience, such as preserving natural dunes and incorporating sustainable water management systems.

FINAnCIAL AnD RESOURCING | TE TAHUA PŪTEA ME NGĀ RAUEMI

19.   Grenadier Limited has agreed to cover the Council’s costs associated with the reclassification and licence process.

20.   The licence fee will be determined by a registered valuer, ensuring fair market rental is applied.

21.     Grenadier Limited will be responsible for maintaining the public walkway, minimising additional costs for the Council.

22.     The proposal aligns with the Reserves Act 1977, which allows for the reclassification of reserve land and the granting of licences for recreational purposes.

23.     The absence of public submissions significantly reduces the likelihood of legal or procedural challenges. The key risks identified include:

·    Potential for Future Objections: While no objections were received during this notification period, ongoing communication with stakeholders and partners is recommended to manage any future concerns.

·    Compliance with Licence Conditions: The licence will include strict environmental and public access requirements to ensure compliance with Council expectations and relevant regulations.

24.     The reclassification of the reserve is consistent with Council’s approach to supporting recreational land use while balancing conservation and public access objectives.

25.     The proposal supports Council’s strategic objectives around economic development, tourism,   and community wellbeing by enabling new recreational infrastructure.

26.     Public notification was carried out through local newspapers and the Council website. The absence of submissions could indicate the acceptance of the proposal by the developers.

·    Draft and execute the licence agreement with Grenadier Limited.

·    Continue engagement with iwi partners and other stakeholders as needed.

1.       This report seeks confirmation in the inclusion of the fee for Local Waters Service Connections/Disconnections in the Fees and Charges for 2025/26.

bACKGROUND | hE KŌRERO TŪĀPAPA

2.       As part of the in-sourcing of Local Waters Service Delivery it has been necessary to add additional fees to Council’s schedule of fees and charges.

3.       In preparing the Fees and Charges Schedules for 2025/26 two fees that were previously charged on as quoted basis was not included.  These are:

·    Local Waters Network Service Connection Works – As Quoted 

·    ​Local Waters Network Service Disconnection Works – As Quoted 

DISCUSSION | HE MATAPAKINGA

4.       These as quoted fees were not included in the Fees and Charges for 202/26 as adopted by Council on 11 December 2024.

5.       These fees are not new fees, but simply a consequence of in-sourcing Local Waters Service Delivery.

6.       Following Council’s confirmation of these fees, they will be added to the Fees and Charges for 2025/26, along side the 2025/26 Annual Plan.

7.       As these fees are on an as quoted basis there is no effect on Council’s budget.

2.      As per the Shannon Community Development Trust Deed, the power of appointment of new trustees shall be vested in the Council.

B.      That this matter or decision is recognised as not significant in terms of S76 of the Local Government Act.

C.      That the Horowhenua District Council appoints James Disney as a Trustee of the Shannon Community Development Trust.

Background | HE KŌRERO TŪĀPAPA

3.       The Shannon Community Development Trust was established in August 2012 to support and benefit the Shannon community. The Trust is classified as a Council Controlled Organisation.

4.       Following the retirement of original Trustee John Williams, there is the need to appoint a new Trustee to fill the vacancy.

5.       The Trust consists of five Trustees.  The current Trustees are Jodi Woodmass (Chair), Virginia O’Connor, Robbie Shaw and Miranui Ward Councillor Cr Paul Olsen.

6.       As outlined in the Trust Deed, the Shannon Community Development Trust AGM was notified 14 days in advance. During this time, expressions of interest for the vacant Trustee position were also sought. The AGM notice and call for expressions of interest were advertised in the Chronicle, Community Connection, and on the Shannon Community Facebook page.

7.       One expression of interest was received from Shannon resident, James Disney.

8.       Mr Disney attended the Shannon Community Development Trust AGM on 18 November, where he provided a brief overview of his experience and skills, highlighting his potential contributions to the Trust.

9.       The Trustees believe that Mr Disney possesses the necessary attributes for the role and have recommended him for appointment by the Council.

10.     In accordance with the Shannon Community Development Trust Deed, the power to appoint new Trustees rests with the Council.

Discussion | HE MATAPAKINGA

11.     Council is required to appoint one Trustee to the Shannon Community Development Trust to restore the total number of Trustees to five.

12.     Mr Disney’s curriculum vitae is attached to this report to assist the Council in determining his suitability for the role.

13.     As outlined in the Trust Deed, the required attributes of a Trustee are as follows:

7.3     The Trustees shall be appointed on the basis that they have identified skills, knowledge and/or experience based on the following attributes:

          (a)     Skills, knowledge and/or experience relevant to the purpose of the Trust;

(b)     Appreciation of the wider public interest and ability to contribute positively to the achievement of the purpose of the Trust;

(c)     Understanding of government issues;

(d)     High standards of person integrity;

(e)     Time available to undertake the duties of a Trustee;

(f)      No conflict of interest

7.4     All Trustees shall be resident in the Horowhenua District and one Trustee shall be a Ward Councilor.

2.       The full Organisation Performance Report is prepared for every second full Council meeting and aims to provide a comprehensive overview of the activities of each of the five groups within Council, a financial summary report and reporting against each of the Statement of Service Performance (SSPs) and Organisation Performance Measures (OPMs).

3.       The report aligns with the Council 2024/25 Plan on a Page which was adopted in July 2024, and reports on the status of each of the top priorities identified by Council.

4.       The intent of the report is to prompt open, transparent and constructive discussion both around the Council table and within the community. It is a record of work undertaken by the organisational arm of Council and outlines progress against actions which align with the Council's vision and the community's expectations.

3.       Attendance at public workshops and briefings is not formally recorded, as these are not considered meetings under the Local Government (Official Information and Meetings) Act 1987. However, since these sessions are live-streamed, the attendance of elected members is a matter of public record, though still not easily accessible to the public.

4.       For completeness attendance at non-public workshops, briefings, taskforces or steering groups is included in the attendance statistics.

5.       This report pulls together the information on attendance together in one place for easy reference by Elected Members and members of the public.

6.       This report does not reflect the additional work that Elected Members’ undertake outside of organised meetings.
